Life Balance Essentials – Terms & Conditions

These Terms & Conditions apply to services, programs, workshops, memberships, subscriptions and other services provided by Life Balance Essentials.

By purchasing a service, booking a session, enrolling in a program, subscribing to a membership or otherwise engaging Life Balance Essentials, you agree to these Terms & Conditions.

1. About Life Balance Essentials

Life Balance Essentials provides practical support designed to help individuals and families manage their life administration, organisation, planning and day-to-day tasks.

Depending on the service purchased, this may include life administration support, personal or family concierge services, productivity support, workshops, online programs, group programs, capacity-building programs and related educational resources.

The specific services included in your engagement will be outlined at the time of booking or purchase.

2. Booking and engaging our services

When you book or purchase a service, you agree to provide accurate and current information that is reasonably required for us to provide that service.

A booking or purchase is confirmed when payment has been received or, where an alternative payment arrangement has been agreed, when the engagement has been confirmed by Life Balance Essentials.

We may decline or discontinue an engagement where we reasonably believe that the service is not suitable for your needs, falls outside the services we provide, or cannot be provided safely or appropriately.

3. Fees and payment

Fees are as displayed on our website, booking page, proposal, invoice or other written agreement provided to you.

Unless otherwise agreed, payment is required before a service, program, workshop or membership commences.

Payments may be processed through third-party payment providers, including Stripe. By making a payment through a third-party payment provider, you acknowledge that the payment may also be subject to that provider’s terms and privacy practices.

For recurring subscriptions or memberships, you authorise the applicable payment provider to process recurring payments in accordance with the subscription you have selected.

If a payment fails, we may contact you to arrange payment or suspend access to the relevant service until payment is received.

4. Programs, workshops and group sessions

Where you enrol in a program, workshop or group service, the inclusions, duration, session dates and price will be provided at the time of purchase.

Program and workshop materials are provided for the participant’s personal use unless we agree otherwise in writing.

If a participant misses a group session, we are not generally required to provide an individual replacement session. Where recordings, resources or alternative arrangements are available, these will be communicated as part of the relevant program.

Life Balance Essentials may make reasonable changes to session dates, facilitators, delivery methods or program arrangements where circumstances require it. Where a significant change is required, we will communicate this to participants as soon as reasonably practicable.

5. Cancellations and rescheduling

Cancellation and rescheduling arrangements may vary depending on the service purchased and will be communicated at the time of booking.

For individual appointments, reasonable notice is requested where you need to cancel or reschedule.

For programs, memberships and workshops, any specific cancellation or refund arrangements stated at the time of purchase will apply.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights you may have under the Australian Consumer Law.

6. Refunds

Our refund arrangements may vary depending on the nature of the service.

Where a service has not yet commenced, we may provide a refund in accordance with the cancellation terms applicable to that service.

Once a service, program, workshop or subscription has commenced, refunds will generally be considered having regard to the circumstances, the services already provided and any applicable cancellation terms.

If you believe a service has not been provided as required under Australian Consumer Law, please contact us so that we can discuss the issue and appropriate remedy.

Nothing in these Terms & Conditions limits your rights under the Australian Consumer Law.

7. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

You are also entitled to have services remedied where there is a failure that does not amount to a major failure, in accordance with your rights under the Australian Consumer Law.

8. Life administration and concierge services

Where you engage Life Balance Essentials to assist with life administration or concierge tasks, we will use reasonable care and skill in carrying out the agreed services.

Some tasks may require us to communicate with third parties, make enquiries, arrange appointments, organise information or assist with administrative processes.

We rely on information provided by you and on information supplied by third parties. We cannot guarantee the accuracy, availability, response times or decisions of third parties.

Where we make bookings or arrangements on your behalf, any terms, fees, cancellation policies or conditions imposed by the third-party provider will also apply.

You remain responsible for confirming that any booking, appointment, purchase or arrangement is suitable for your needs unless we have specifically agreed otherwise.

9. NDIS and capacity-building services

Where Life Balance Essentials provides services to an NDIS participant, the scope of the service will be agreed with the participant, their representative or relevant support person before the service commences.

Our capacity-building services are designed to assist participants to develop skills, systems and confidence in areas such as organisation, communication, appointments, paperwork, planning and managing everyday administration.

Life Balance Essentials does not make decisions about a participant’s NDIS plan, funding or eligibility. We also do not provide financial, legal, medical or clinical advice.

Where services are funded through an NDIS plan, responsibility for confirming that the service is appropriately funded and claimable rests with the participant and/or their plan manager or relevant representative.

10. Information and educational content

Information provided through our programs, workshops, website, resources and services is intended to provide general education and practical support.

It does not constitute legal, financial, medical, psychological or other professional advice unless expressly stated otherwise.

You are responsible for deciding whether information or recommendations are appropriate for your individual circumstances and, where necessary, obtaining advice from an appropriately qualified professional.

11. Third-party services

We may recommend or assist you to communicate with third-party businesses, service providers or professionals.

Unless expressly agreed otherwise, Life Balance Essentials is not responsible for the services, decisions, conduct, availability, pricing or performance of third parties.

Where you purchase goods or services directly from a third party, your agreement is with that third party.

12. Your responsibilities

You agree to:

  • provide information that is accurate and reasonably complete;
  • provide information in a timely manner where it is required for us to complete an agreed task;
  • communicate any relevant changes to your circumstances;
  • treat Life Balance Essentials staff, contractors and other participants respectfully; and
  • not use our services, resources or materials for unlawful purposes.

If we are unable to complete a task because required information or instructions have not been provided, we may need to reschedule or charge for time already spent, where applicable to the agreed service.

13. Intellectual property

All materials created or supplied by Life Balance Essentials, including workbooks, templates, checklists, worksheets, presentations, training materials, written content and other resources, remain the intellectual property of Life Balance Essentials unless otherwise stated.

You may use these materials for your own personal use.

You must not reproduce, sell, distribute, publish, modify for commercial use, share publicly or use our materials to provide services to others without our written permission.

14. Confidentiality

We will treat information you provide to us as confidential and will only use or disclose it as reasonably necessary to provide our services, comply with our legal obligations, process payments, operate our business or where you have otherwise authorised us to do so.

Our handling of personal information is also governed by our Privacy Policy.

15. Privacy

Life Balance Essentials collects and handles personal information in accordance with our Privacy Policy.

Our Privacy Policy explains what information we collect, why we collect it, how we use and store it, when it may be disclosed to third parties and how you can access or correct your information.

16. Online services and technology

Where services are delivered online, we rely on internet, communication and third-party technology platforms.

While we take reasonable steps to provide reliable services, we cannot guarantee that online services will always be uninterrupted or free from technical problems.

Where a technical issue prevents a scheduled service from being delivered, we will make reasonable efforts to provide an alternative arrangement.

17. Changes to services and these Terms

We may update these Terms & Conditions from time to time to reflect changes to our services, business practices or legal requirements.

The current version will be published on our website.

Where a change materially affects an existing ongoing service or subscription, we will provide reasonable notice where appropriate.

18. Limitation of liability

To the extent permitted by law, Life Balance Essentials will not be responsible for loss or damage arising from circumstances outside our reasonable control, including the acts or omissions of third parties, technical failures, delays caused by third parties or information supplied to us that is inaccurate or incomplete.

Nothing in these Terms & Conditions excludes, restricts or modifies any liability or consumer right that cannot lawfully be excluded, restricted or modified under Australian law.

19. Events outside our control

We will not be responsible for delays or inability to provide services caused by circumstances beyond our reasonable control, including serious illness, natural disasters, significant technology failures, government restrictions, interruptions to essential services or other unforeseen events.

Where this occurs, we will make reasonable efforts to communicate with you and, where practical, arrange an alternative service or date.

20. Ending an ongoing service

Either party may end an ongoing service arrangement by providing the notice period agreed when the service commenced.

Any outstanding fees for services already provided or commitments already incurred remain payable.

Where a subscription or membership is cancelled, access to the relevant service will generally continue until the end of the period already paid for unless otherwise stated at the time of purchase.

21. Complaints and concerns

We want you to be happy with the services you receive.

If you have a concern or believe that a service has not been provided as expected, please contact us as soon as possible so that we can discuss the issue and work towards a reasonable resolution.

22. Governing law

These Terms & Conditions are governed by the laws of Victoria, Australia.

Any dispute will be dealt with in accordance with applicable Australian law.
